Welcome to WaCre Skill Centre

These Terms and Conditions ("Terms") govern your access to and use of the Wacre Skill Centre online learning platform, website, mobile applications, and all related services (collectively, the "Services").

WaCre Skill Centre ("WaCre," "we," "our," or "us") provides online technology education courses designed to equip learners with market-ready skills. Our platform offers live interactive classes, self-paced learning materials, and professional instruction in various technology fields.

By creating an account, enrolling in courses, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and WaCre Skill Centre.

Important: Please read these Terms carefully. If you do not agree to these Terms, you must not access or use our Services.

  1. Acceptance of Terms

By accessing and using the WaCre Skill Centre platform, website, or any of our services, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and WaCre Skill Centre.

If you do not agree to these terms, you must not access or use our services. Your continued use of the platform constitutes your acceptance of any updates or modifications to these terms.

These terms apply to all users of the platform, including students, instructors, visitors, and any other individuals who access our services.

  2. Eligibility and Account Registration Age Requirement

You must be at least 16 years of age to use our services. If you are under 18, you represent that you have obtained parental or guardian consent to use our platform.

Account Creation

To access certain features and enroll in courses, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary to keep it accurate and current.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violating these terms or for any other reason we deem appropriate.

  3. Course Enrollment and Payment Enrollment Process

To enroll in a course, you must complete the registration process and pay the applicable course fee. Your enrollment is confirmed only after we receive full payment.

Course Fees

All course fees are listed in Kenyan Shillings (KES) and must be paid in full before accessing course materials. We reserve the right to change course prices at any time, but price changes will not affect courses you have already enrolled in.

Payment Methods

We accept payment through various methods including mobile money (M-Pesa), bank transfer, and credit/debit cards. All payments are processed through secure third-party payment processors.

Payment Terms

Payment is due immediately upon enrollment unless otherwise specified. We operate on a pay-per-course model. Each course is paid for separately at the time of enrollment.

Taxes

All fees are exclusive of applicable taxes unless otherwise stated. You are responsible for paying any applicable taxes, duties, or government charges.

  4. Refund and Cancellation Policy Refund Eligibility

You may request a full refund within 7 days of enrollment if you have not accessed more than 20% of the course content. After this period, or if you have accessed more than 20% of the content, refunds are not available.

Refund Process

To request a refund, you must submit a written request to our support team at support@wacreskillcentre.com with your enrollment details and reason for the refund. Refunds will be processed within 14 business days of approval.

Course Cancellation by WaCre

We reserve the right to cancel any course due to insufficient enrollment, instructor unavailability, or other circumstances. In such cases, you will receive a full refund or the option to transfer to another course of equal value.

Non-Refundable Items

Certificates, completed courses, and promotional or discounted course fees may be non-refundable. Specific refund conditions will be clearly stated at the time of purchase.

  5. Course Access and Content Access Duration

Upon enrollment, you will have access to course materials for the duration specified in the course description. For most courses, this includes access during the active course period plus 30 days after course completion for review purposes.

Live Classes

Live interactive classes are scheduled at specific times. While we record live sessions for later review, attendance at live classes is strongly encouraged for the best learning experience. We are not responsible if you miss a live session.

Course Content Updates

We reserve the right to modify, update, or discontinue course content at any time. While enrolled students will generally retain access to the version they purchased, we may update materials to reflect current industry practices.

Technical Requirements

You are responsible for ensuring you have the necessary equipment, software, and internet connection to access our courses. Minimum technical requirements are listed on each course page.

Course Completion

To receive a certificate of completion, you must meet the course requirements which may include attending live sessions, completing assignments, and passing assessments as specified in the course syllabus.

  6. Intellectual Property Rights Ownership

All content on the WaCre Skill Centre platform, including but not limited to course materials, videos, text, graphics, logos, software, and other materials, are owned by or licensed to WaCre Skill Centre and are protected by copyright, trademark, and other intellectual property laws.

Limited License

Upon enrollment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use course materials solely for your personal, non-commercial educational purposes.

Prohibited Uses

You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, or exploit any course content without our express written permission. You may not share your account credentials or course access with others.

Student Work

You retain ownership of any original work you create as part of course assignments. By submitting work to the platform, you grant us a non-exclusive license to use, reproduce, and display your work for educational and promotional purposes.

Trademark

WaCre Skill Centre, WaCre, and related logos are trademarks of WaCre. You may not use our trademarks without prior written consent.

  7. User Conduct and Prohibited Activities Acceptable Use

You agree to use our platform in a lawful, respectful, and appropriate manner. You must not engage in any activity that disrupts or interferes with the platform or other users' access to our services.

Prohibited Activities

You may not: (a) violate any applicable laws or regulations; (b) infringe on the intellectual property rights of others; (c) transmit viruses, malware, or other harmful code; (d) harass, abuse, or harm other users; (e) impersonate any person or entity; (f) engage in fraudulent activities; (g) scrape, data mine, or use automated tools to access the platform; (h) share or sell course content; (i) create multiple accounts; or (j) circumvent security measures.

Academic Integrity

You must maintain academic integrity and honesty. Cheating, plagiarism, or any form of academic dishonesty may result in course failure and account termination without refund.

Respectful Communication

All interactions with instructors, staff, and fellow students must be respectful and professional. Harassment, discrimination, hate speech, or inappropriate behavior will not be tolerated.

  8. Disclaimers and Limitations of Liability Service Availability

We strive to provide uninterrupted access to our platform but do not guarantee that our services will be available at all times or free from errors. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

Educational Outcomes

While we design our courses to provide market-ready skills, we do not guarantee employment, income, or specific career outcomes. Your success depends on many factors including your effort, prior experience, market conditions, and other circumstances beyond our control.

Third-Party Content

Our platform may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is at your own risk.

Limitation of Liability

To the maximum extent permitted by law, WaCre Skill Centre shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use or inability to use our services; (b) any unauthorized access to or use of our servers; (c) any interruption or cessation of transmission to or from our services; (d) any bugs, viruses, or malware transmitted through our services; or (e) any errors or omissions in any content.

Maximum Liability

Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or KES 10,000, whichever is less.

No Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

  9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference.

By using our services, you consent to our collection and use of your information as described in our Privacy Policy. Please review our Privacy Policy to understand our practices.

  10. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. We will notify you of material changes via email or through a notice on our platform.

Your continued use of our services after changes are posted constitutes your acceptance of the modified terms. If you do not agree to the changes, you must stop using our services.

The "Last Updated" date at the top of this page indicates when these terms were last revised.

  11. Termination By You

You may terminate your account at any time by contacting our support team. Upon termination, you will lose access to all course materials and any unused portions of your enrollment will not be refunded unless otherwise specified in our refund policy.

By Us

We may suspend or terminate your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms and Conditions. Upon termination, your right to use our services will immediately cease.

Effect of Termination

Upon termination, all provisions of these Terms and Conditions which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

  12. Indemnification

You agree to indemnify, defend, and hold harmless WaCre Skill Centre, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of our services; (b) your violation of these Terms and Conditions; (c) your violation of any third-party rights, including intellectual property rights; or (d) any harmful or unlawful conduct in connection with your use of our services.

  13. Governing Law and Dispute Resolution Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these terms shall first be attempted to be resolved through good faith negotiations between the parties. If negotiations fail, disputes shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.

Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Nairobi, Kenya, for any legal proceedings that are not subject to arbitration.

  14. General Provisions Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other legal notices published by us on our platform, constitute the entire agreement between you and WaCre Skill Centre regarding your use of our services.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect.

Waiver

No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these terms or your rights under these terms, in whole or in part, without our prior written consent. We may assign these terms at any time without notice to you.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Headings

The headings and subheadings in these terms are for convenience only and do not affect the interpretation of these terms.

  15. Certificates and Credentials Certificate Issuance

Upon successful completion of a course and meeting all specified requirements, you will receive a certificate of completion from WaCre Skill Centre. Certificates are issued digitally and can be downloaded from your account.

Certificate Validity

Our certificates represent completion of our courses and acquisition of specific skills. They are not accredited academic degrees or professional licenses unless explicitly stated.

Verification

All certificates include a unique verification code that can be used by employers or other parties to verify authenticity through our website.

Revocation

We reserve the right to revoke certificates if we discover that they were obtained through academic dishonesty, violation of our terms, or fraudulent means.

If you do not agree to these Terms, you must immediately discontinue use of our Services and close your account.
